To purchase a property in Mallorca you need an NIE (número de identidad de extranjeros), which is an obligatory tax number for non residents. You can ask a lawyer to obtain one on your behalf, or do it yourself via the internet.
We always advise every client to instruct a property lawyer when purchasing any property, and we are able to provide recommendatiuons of solicitors that can help you through the buying process. Just like in other countries, it is essential that you carry out full and proper searches of the property, check that buildings are legal and registered with the cadastre (the Spanish version of The Land Registery), the plot boundries are as advised, and the property is free of third party rights, legal proceedings and outsanding debts.
Also, the buyer is responsible to pay their own legal and search fees, and the estate agency fees are covered by the seller, unless otherwise stated.
Once you have agreed to purchase a property, your solicitor will prepare an option contract, and once signed by both parties, the sale is commited.
On the day of purchase you and the seller will attend a Notary (a specialist solicitor in Spain), who will witness and record the deed of sale in front of all parties. Once this is completed, the Notary will hand you the keys to your dream home in Mallorca.
